Ministry Announcement: Guidelines for Submitting Documents or Evidence by Hotel Operators
Hotel operators who have been operating before June 12, 2019, and must be buildings that existed before August 19, 2016, which operate Type 1 or Type 2 hotels without a license, wishing to receive exemption from criminal penalties for violations of hotel laws, building control laws, and urban planning laws, should promptly proceed according to NCPO Order No. 6/2562 by submitting a request for exemption for operating hotels without authorization, violating all three laws mentioned. If located in provinces, submit to the local municipality or sub-district administrative organization where the building is located; if in Bangkok, submit to Bangkok 2, Din Daeng. Please ensure to submit by September 9, 2019, at the latest. Late submissions will not be accepted. Therefore, to protect your rights, please submit as soon as possible.

Subject: Guidelines, Procedures, and Conditions for Submitting Documents or Evidence by Hotel Operators with Buildings as Defined in Clause 2 of NCPO Order No. 6/2562
Subject: Measures to Promote and Develop Standards for Certain Types of Hotel Businesses
Dated June 12, 2019
By virtue of the authority under Clause 2 of NCPO Order No. 6/2562 regarding measures to promote and develop standards for certain types of hotel businesses, dated June 12, 2019, the Minister of the Interior hereby issues the following announcement:
Clause 1: Hotel operators with buildings as defined in Clause 2 of NCPO Order No. 6/2562 regarding measures to promote and develop standards for certain types of hotel businesses, dated June 12, 2019, must submit a letter to the local official in the area where the building is located, stating any violations of the provisions in Clause 2 of the aforementioned order, along with one or more documents or evidence to demonstrate that the building meets the characteristics defined in Clause 3 of the Ministerial Regulation on the Characteristics of Other Types of Buildings Used for Hotel Business, B.E. 2559, which were used for hotel business before June 12, 2019, as follows:
(1) A copy of the construction or modification permit or a copy of the construction or modification certification
(2) A copy showing ownership of the building or the location where the building is situated
(3) A copy of the business operation license that poses a health hazard
(4) Evidence of payment of room tax to the local administrative organization
(5) Evidence of tax payment to the Revenue Department
(6) Evidence of permission to use electricity and water
(7) Evidence of registration request
(8) A copy of the land sale agreement registered with the land official
(9) Evidence of advertising on various websites or advertising contracts
(10) Plans or building layouts that were previously approved for construction or modification
(11) Other documents or evidence that demonstrate that the building meets the characteristics defined in Clause 3 of the Ministerial Regulation on the Characteristics of Other Types of Buildings Used for Hotel Business, B.E. 2559, which were used for hotel business before June 12, 2019.
Clause 2: When the local official receives the letter along with the documents or evidence as specified in Clause 1, they shall proceed according to Clauses 3 and 4 of NCPO Order No. 6/2562 regarding measures to promote and develop standards for certain types of hotel businesses, dated June 12, 2019, thereafter.
Clause 3: This announcement from the Ministry of Interior shall be effective from the date of publication in the Royal Gazette onward.
