For buildings, whether it’s an extension or new construction, permission is required in all cases. However, there are exceptions for home extensions that can be done without submitting plans for permission to local authorities.

            The Building Control Act B.E. 2522 states that if there is any modification or extension of a building, a request for permission must be submitted to the local authorities. Generally, modifications and extensions, especially for residential buildings like single-family homes and townhouses, are often made to increase usable space within the house, which falls under the category of modifications and extensions that require permission.

            However, there are cases of modifications and extensions that are exempt from this requirement, which include five scenarios:

 

Exemptions from Needing Permission for Building Extensions

  1. Adding or reducing the area of any floor by no more than 5 square meters, without adding or reducing the number of columns or beams.
  2. Adding or reducing the area of the roof by no more than 5 square meters, without adding or reducing the number of columns or beams.
  3. Changing the structure of the building using the same materials, sizes, quantities, and types.
  4. Changing any part of the house that is not a structural component using the same materials or other materials that do not increase the weight of the building structure by more than 10% of its original weight.
  5. Changing, extending, or reducing any area that is not a structural component and does not increase the weight of the building structure by more than 10% of its original weight.

      It can be seen that modifications or extensions that do not require permission are mostly minor extensions. In practice, many extensions exceed these exemptions without obtaining permission. If complaints are made or violations are discovered, legal action will be taken, with penalties as follows:

Penalties for Not Requesting Permission for Construction, Modification, or Extension of Buildings

  1. Construction, modification, and extension of the building will be suspended. If corrections can be made, the owner must submit a request for permission or make the necessary corrections within a specified time, not less than 30 days. If corrections cannot be made or the owner refuses to comply with the official's order, parts of the building or the entire structure will be demolished within a specified time, not less than 30 days.
  2. Offenders may face imprisonment for up to 3 months or a fine of up to 60,000 baht, or both.
  3. Offenders will incur an additional fine of up to 10,000 baht per day for the duration of the violation or until compliance is achieved.
